Our platform is designed with the primary goal of providing a transparent, user-friendly, and efficient shopping experience. We leverage advanced technology, including but not limited to web scraping techniques, to gather, analyse, and present data. We do this in strict compliance with South African laws and regulations, and with respect to the principles of fair use and intellectual property rights. By accessing and using our website and services, you acknowledge and agree to these Terms and Conditions. This includes our data collection, processing, and use practices, as outlined in our Privacy Policy. Please note that our services are intended for use only by individuals who are at least 18 years old. If you are under the age of 18, you are not permitted to use our website or services.

Merchant Eligibility

To be eligible as a Merchant on our platform, you must meet the following criteria:

  1. You must be engaged in the lawful marketing and/or sale of your own products and/or services ("Products") that cater to the South African market. This includes both online and offline sales channels.
  2. You must own and operate a website and/or physical store where these Products are available for purchase. The website must be publicly accessible, and the information about the Products, including but not limited to their prices, must be openly displayed.
  3. You must possess all necessary rights, licenses, and permissions to offer these Products for sale. This includes, but is not limited to, compliance with all applicable laws and regulations, as well as respect for intellectual property rights.
  4. You must be able to provide clear and accurate information about your Products, including their prices, to ensure that our price comparison service is accurate and reliable.

You must understand and accept that we use open-source data available to the public, including data from your website, to determine the best prices offered by Merchants for the benefit of our Users. We do this in strict compliance with South African laws and regulations, and with respect to the principles of fair use and intellectual property rights. Our aim is to make this information accessible to shoppers in a user-friendly and efficient manner.

Please note that we respect the terms and conditions of the websites we scrape data from, and we strive to operate within the confines of these terms and the law. We do not require explicit agreement from the merchants to our terms and conditions, as our operations are based on the public availability of data on their websites. However, we reserve the right to exclude any merchant from our platform if we determine that scraping their data is in violation of their terms and conditions, or any applicable laws or regulations.

Data Collection and Use

In accordance with the Protection of Personal Information Act (POPIA), we are committed to ensuring the privacy and protection of your personal data. Here's how we collect and use data:

Our platform is designed to empower consumers by providing them with the ability to compare prices of various products from different merchants, thereby enabling them to make informed purchasing decisions. For Merchants, we offer the opportunity to showcase their products to a broad audience of potential customers. By listing your products on our platform, you gain increased visibility and potential customer reach.

Our services extend beyond just listing products. We utilize advanced data analytics to provide valuable insights to Merchants. We generate reports detailing the popularity of products based on user interactions, and the sales available to the general public for them to make informed decision on the their engagements with Merchants. It's important to note that the data we collect and use is obtained through lawful means, in compliance with the Protection of Personal Information Act (POPIA) and other relevant data protection laws. We employ web scraping techniques to gather publicly available data from various merchant websites. This data is then processed and analyzed to provide the comparative pricing information and analytics reports. Our web scraping activities are conducted in a manner that respects the rights of the data owners and does not infringe upon their terms of service. We strive to operate within the confines of the law, ensuring that our activities align with the principles of fair use and openness. By using our platform and services, you agree to these Terms and Conditions. Please note that while we strive to provide accurate and up-to-date information, we cannot guarantee the absolute accuracy of all data presented on our platform due to the dynamic nature of product pricing and availability.

Content and Parity with Merchant's Sales Channels

As a consumer-facing platform, Zozaa Pty Ltd is committed to ensuring that the information we provide to our users is legal, accurate, relevant, comprehensive, and up-to-date. We gather data from various merchant websites, and it is crucial that the content we present respects these principles. We do not tolerate any form of impersonation or misleading information.

While we do not directly control the content on the merchant websites we scrape data from, we expect that the merchants maintain the integrity and legality of their content. Any product listed on our platform must be legal and accurately represented on the merchant's website. In terms of parity, we believe in providing our users with the most favourable terms available. Therefore, we expect that the prices and terms of sale for products listed on our platform are at least as favourable to Zoza users as the most favourable terms upon which a product is offered and/or sold via the merchant's own sales channels.

Merchants are free to determine which of their products they wish to list for sale on Zozaa. However, they must ensure that the terms of offer and/or sale of their products, including the purchase price, are consistent across all their sales channels, including Zoza.

By using our platform and services, merchants implicitly agree to these terms and conditions. We reserve the right to remove any merchant or product from our platform that does not adhere to these guidelines, to maintain the integrity of our platform and to ensure the best possible experience for our users.

Commencement and Termination

This Agreement comes into effect upon our acceptance of your registration application and will continue indefinitely, subject to termination under the conditions outlined in this Agreement.

Please note that as long as you utilise any of the services provided by Zozaa Pty Ltd, you are bound by the terms and conditions of this Agreement. We reserve the right to terminate this Agreement and your access to our services at any time, with or without cause, and with or without notice.

Reasons for termination may include, but are not limited to, your breach of any terms and conditions of this Agreement, a request by law enforcement or other government agencies, discontinuance or material modification to our services, unexpected technical or security issues or problems, and/or engagement by you in fraudulent or illegal activities.

Upon termination of this Agreement, all rights and licenses granted to you under this Agreement will cease immediately, and you agree to stop all access and use of our services.

Furthermore, upon termination, all of your rights under this Agreement will automatically terminate, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or our services.

Please note that we will not be liable to you or any third party for any termination of your access to our services or deletion of your information or account.
